1. Acceptance of Terms

If you do not agree, please do not use our website or engage our services. These terms apply to all visitors, customers, and others who access the site or hire us for work.

2. Description of Services

Premier Cupertino Concrete Company provides concrete contracting services to residential and commercial customers in and around Cupertino, CA. Services include, but are not limited to:

• Concrete driveways, patios, and walkways
• Stamped and decorative concrete
• Garage floors and interior concrete slabs
• Concrete retaining walls and steps
• Foundations, footings, and slab work
• Concrete pool decks and parking lots
• Foundation raising and concrete cutting

All services are performed by our employees or direct subcontractors in accordance with applicable California building codes and permit requirements.

3. Estimates and Pricing

Estimates are provided free of charge following an on-site assessment. Written estimates reflect conditions observed at the time of the visit. Final pricing may change if:

• Subsurface conditions differ from what was visible during the estimate (such as buried debris, old concrete, or unexpected soil conditions)
• The scope of work changes at the customer's request after the estimate is signed
• Material costs increase significantly between estimate and project start date, beyond normal market fluctuation
• Permit fees or inspection requirements exceed initial projections

Any change to the original estimate will be communicated in writing before work proceeds. No additional charges will be applied without written authorization from the customer.

4. Scheduling and Cancellation

Once a signed contract and deposit are received, a start date will be confirmed in writing. The following applies:

• Cancellations made more than 5 business days before the scheduled start date will receive a full refund of any deposit paid.
• Cancellations made within 5 business days of the start date may result in forfeiture of the deposit to cover material ordering and crew scheduling costs.
• We may reschedule projects due to weather conditions, permit delays, or circumstances beyond our control. We will notify you as soon as possible and provide a new start date.
• If you need to reschedule, please contact us at least 3 business days in advance to avoid scheduling fees.

5. Payment Terms

Payment terms will be stated in your written contract. Standard terms are:

• A deposit is required before work begins. The deposit amount will be stated in the contract.
• The remaining balance is due upon project completion.
• Invoices not paid within 30 days of completion may be subject to a late fee of 1.5% per month on the outstanding balance.
• For larger projects, a progress payment schedule may be established in the contract.

We accept payment by check, bank transfer, or other methods stated in your contract. Payment does not constitute a waiver of any warranty rights.

6. Warranty Disclaimers

We stand behind our workmanship. Any warranty terms specific to your project will be stated in your written contract. The following general disclaimers apply:

• Concrete is a natural material. Surface cracking, minor color variation, and slight surface texture differences are inherent characteristics of concrete, not defects.
• Warranty coverage does not extend to damage caused by improper use, vehicle overloading, chemical exposure, tree root intrusion, or acts of nature.
• Sealing requirements are the responsibility of the property owner after project completion unless sealing is specifically included in the contract scope.
• Subsurface conditions not visible at the time of estimate, such as underground utilities, soft soil, or buried structures, are outside our warranty coverage.

The website and its content are provided as-is. We make no warranties, expressed or implied, regarding the accuracy or completeness of information on the site.

7. Limitation of Liability

To the fullest extent permitted by California law, Premier Cupertino Concrete Company shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of this website or from any service engagement, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from a service project shall not exceed the total amount paid by you for that project.

8. Dispute Resolution

If a dispute arises from any service agreement or from your use of this website, we encourage you to contact us first to resolve it directly. Most issues can be addressed quickly through open communication.

If we are unable to resolve the dispute informally, both parties agree to attempt resolution through mediation before pursuing litigation. Any unresolved disputes shall be submitted to binding arbitration in Cupertino, CA, in accordance with the rules of the American Arbitration Association. You waive any right to a jury trial on any dispute covered by this agreement.

9. Governing Law

These Terms and Conditions and any service agreements entered into with Premier Cupertino Concrete Company are governed by the laws of the State of CA, without regard to conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought in the courts of Santa Clara County, California.

10. Intellectual Property

All content on this website - including text, images, logos, and page layouts - is the property of Premier Cupertino Concrete Company or its content suppliers and is protected by applicable intellectual property laws.
